Terms and Exclusions of Liability Engine and/or Vehicle Testing and Storage.
Definitions:
JB-Tech Racing LLC, is hereafter as JB-Tech. Owner includes the owners nominated agent, customer or corporation. Testing includes repair, tuning, fitting, development and the supply of parts an equipment.
JB-Tech accept that the owner warrants that any engine and/or vehicle accepted for testing is delivered in a suitable condition for any loads, speeds or temperatures that would be imposed, or may arise, during such testing and that all parts used in the engine and vehicle during testing. Testing normally imposes loads exceeding manufacturers design specifications.
The owner or his/her nominated agent may either view and control such testing or supply written instructions detailing any conditions or restrictions they may wish to impose during such testing. If no instructions are given, the owner/agent agrees, by implication and default the JB-Tech will carry out any and all testing at the discretion of the JB-Tech employee.
JB-Tech WILL NOT be responsible for any damage, no matter how so arising, which may occur during testing or fitting of the engine or vehicle, or any direct or consequential cost or costs as a result of such testing or fitting. IE: ALL RISK ARE EXCLUSIVELY THAT OF THE OWNER.
JB-Tech does not cover any insurance covering any customer property, engines, vehicle's or parts for any risks at all. JB-Tech therefore are under no duty or responsibility of any sort whatsoever and whenever in contract or in tort or otherwise for any loss including theft, burglary, damage, harm or reduction in value which happens to the customer’s property however that occurs.
JB-Tech reserves the right to withhold customer property until payment in full for work carried out and parts supplied has been made.
The above terms and exclusions of liability only apply to the extent not prohibited or made void by law but subject only to that they are sole basis on which JB-Tech are willing to take on the work or other responsibilities.
The undersigned releases JB-Tech and its employees and agents from any and all liability. The governing law of contract between JB-Tech and you the customer is the law. This is a legally binding document.
